I gave PowerPoint presentations on the following topics between 14:00 and 17:00 with short breaks for questions and answers:
- An overview of intellectual property law covering the difference between intellectual property and intellectual assets, categorization of intellectual property rights, how brands, designs, technology and creativity are protected, the main features of patents, registered designs and supplementary unregistered designs, copyrights, rights in performances, unregistered design rights, trade marks, passing off and obligations of confidence. assignments and licences and enforcement;
- Licences, consultancy agreements and spin-offs including the provisions of a carefully drawn patent, know-how or software licence, practical and legal considerations on setting up a spin-off, negotiating agreements subject to contract, confidentiality agreements and a review of each of the Lambert agreements;
- Ownership of IP covering s.7, s.39 and s.40 of the Patents Act 1977, s.2 of the Registered Designs Act 1949 and s.11 and s.215 of the Copyright, Designs and Patents Act 1977, the IP provisions of Oxford University's Statute and Regulations and the IP policies of other universities; and
- My analysis of Daniel Alexander KC's judgment in Oxford University Innovation v Oxford Nanoimaging and its implications for other universities.
