Works of art and literature in permanent form such as choreography, drawings, engravings, films, musical compositions, novels, photographs, plays, sculptures and sound recording are protected from unauthorized reproduction, distribution and performance by copyright. Unauthorized broadcasting, filming or taping of performances by actors, dancers, musicians, singers or other performers by rights in performances.
Copyright law in the UK is codified by Part I of the Copyright, Designs and Patents Act 1988 and rights in performances by Part II.
There is no system of registration for copyrights or rights in performances in the UK. Those rights come into being automatically upon the fulfilment of certain conditions. Her Majesty's government is party to the Berne Convention for the Protection of Literary and Artistic Works ("Berne") and the Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations ("Rome") which provides for the mutual recognition and enforcement of the copyrights and rights in performances of the nationals and residents of the contracting parties.
The rights mentioned above are sometimes referred to as economic rights. In addition to those rights authors of certain copyright works and performers enjoy what are known as moral rights. Authors have the rights to be identified as author, to object to derogatory treatment of their work and to object to false attribution of work and performers to be identified as the performer and to object to derogatory treatment of their performances.
