Case No. DRO2018-0012 Automobile Club di Brescia v. Zhao Ke

It is well known that the WIPO's Arbitration and Mediation Centre resolves generic top-level domain name disputes. It also resolves top-level domain name disputes for a number of countries. One of those countries is Romania.

Over the Christmas holidays, I was asked to consider a complaint by the Automobile Club of Brescia against one Zhao Ke in China.  I decided the case on 4 Jan 2019.  Those who are interested in the case will find my decision here.  There was nothing unusual about this case either on the facts or in law but it was my first country code dispute and it concerned the famous Mille Miglia road race between Brescia and Rome and back.

"Mille Miglia" means "1,000 miles" in Italian which was the approximate length of the course.  I suppose the name was chosen for its assonance.  It slips off the tongue far more easily than ""1,600 kilometres" or even   "1.600 chilometri" notwithstanding that Italy has used metric weights and measures for as long as the race has been held.

Just before and just after the second world war, it was a major motorsports event for both manufacturers and drivers.  The British driver, Stirling Moss, made his name in the Mille Miglia.  Unfortunately, there were a number of serious accidents and the race and the course had to close down for safety reasons.  It was revived in 1977 as an event for vintage cars, that is to say, those constructed before 1957.

Returning to domain name disputes I have advised and acted as counsel as well as a dispute resolution panellist for many years.  You will find information in "Services Relating to Branding". Anyone wishing to discuss this article or domain name dispute resolution generally should call me on +44 (0)20 7404 5252 during office hours or send me a message through my contact page.
