IP for Commercial Lawyers - 2018 Conference

Jane Lambert

I have been invited to speak ar MBL's IP for Commercial Lawyers - 2018 Conference which will take place in London between 09:30 and 17:15 on 27 Nov 2018.  The conference will cover a wide range of topics from basic concepts to the effect of Brexit on IP rights.  My topic is "Patents - What happens after Brexit£ which will address the thorny question of whether there is any chance that the Unified Patent Court will ever open its doors.

As brands, designs and plant varieties can be protected throughout the European Union by EU trade marks, registered and unregistered Community designs and Community plant variety rights and as much of our national trade mark, registered design, copyright, trade secrecy and patent law has been harmonized by EU directives, our withdrawal from the EU will have far-reaching consequences for British businesses which I have charted in my Brexit blog.

Recently the government has published a series of guidance notes to businesses and individuals on how to prepare if the UK leaves the EU without a withdrawal agreement. Some of these concern intellectual property which I have discussed in my Brexit blog and summarized in IP after Brexit - The Government's Guidance  22 Oct 2018 NIPC News.

My contribution to the IP for Commercial Lawyers - 2018 Conference will cover:
  • The European Patent Convention, European Patent Office and European patents
  • Previous attempts to create a Pan-European patent and a European patent court
  • Regulations 1257/2012 and 1260/2012
  • Unified Patent Court Agreement
  • Ratifications
  • German litigation
  • Effect of Brexit
  • Why the unitary patent and Unified Patent Court will still benefit the UK even if it has to withdraw from the agreement
  • Future of the UPC and unitary patent after Brexit.
Attendees will receive a full set of notes, references and URLs for further reading.

The conference will be chaired by Mark Weston of Hill Dickinson. The other speakers will be Richard Hodgson of Design Chambers and Lorna Brazell of Osborne Clarke.   The conference will deliver 6 hours  CPD and cost £500.  Click here if you want to register.
